2- General provisions
These general terms and conditions of sale of SMA OPTIQUE define the rights and obligations of the parties, hereinafter referred to as "the client" on the one hand and "the website" referring to VISIONALIS SMA OPTIQUE on the other, in the context of the sale of products and services by VISIONALIS SMA OPTIQUE to clients of the website visionalis.fr.
Each purchase or booking of a product or service made by a client on the website under the conditions set forth in these general terms and conditions of sale shall hereinafter be referred to as "the order".
Any confirmation by the client of an order placed on visionalis.fr implies irrevocable acceptance of the general terms and conditions of sale, without this acceptance requiring a handwritten signature from the client.
These general terms and conditions of sale apply without restriction or reservation to all sales concluded by VISIONALIS. They are subject to change; the applicable conditions are those in effect on www.visionalis.fr at the time the client places the order.
3- Client obligations
The client certifies:
- being of legal age
- having read and unreservedly accepted these general terms and conditions of sale prior to placing an order
- for corrective equipment orders, being in possession of their vision correction details. These corrections must come from a medical prescription issued by an ophthalmologist
- being aware that they may meet or contact an optician at the VISIONALIS retail store
VISIONALIS reserves the right to verify the client’s identity by requesting an official ID.
4- Ordering process
-
User identification
To place an order, the user must log in using their username and password. For a first-time order, the user must follow the account creation procedure indicated on the website.
In case of a lost or forgotten password, the user may request a new one by visiting their client account and clicking on "forgot password?". They will then receive a new password at the email address provided during registration.
-
Order registration and validation
The user can place an order online using the online catalogue. Products are selected by adding them to the shopping cart.
By validating the cart, a free quote is provided to the client in the form of an order summary, listing all product prices and shipping fees. The client accepts this quote in accordance with legal provisions by clicking the “validate order” button. The order becomes final only once payment is received. This validation constitutes an electronic signature which, between VISIONALIS and the client, has the same legal value as a handwritten signature and serves as proof of the entire order, of the amounts due under said order, and of full and unreserved acceptance of these general terms and conditions of sale and the quote.
Once the cart is validated, the user must accept the general terms and conditions of sale, select the delivery address, and confirm the payment method. This final step formalizes the sales contract between VISIONALIS and the user. VISIONALIS will confirm receipt of the order upon validation by sending a confirmation email, which includes a link to track the order.
5- Product and service conformity
Each product offered on the VISIONALIS.FR website is described and presented with the greatest possible accuracy. A detailed product sheet with photo(s) is accessible by clicking on the item. The information provided on each product sheet corresponds to the details communicated to SMA OPTIQUE by its suppliers. The photographs and descriptive texts used to illustrate the products are not contractually binding. VISIONALIS takes great care to publish accurate and essential product information, including technical descriptions from partners and suppliers and product photos.
If an error in description or imagery is identified, we commit to correcting it as quickly as possible.
In the event of non-conformity of the product or service delivered to the client, or of damage during transport, the client may return the product to VISIONALIS. This applies in the following cases:
- The package is damaged: the client must refuse the package upon delivery or request a damage certificate from the carrier.
- The product delivered is different from the one ordered.
To be eligible for replacement with an identical item or a refund, the client must submit a claim within 15 days of receiving the parcel. Any claim made after this period will be rejected, and VISIONALIS will be released from all liability.
Within the same time frame, the client must return the item in its original packaging, via tracked or registered mail.
To benefit from a product replacement or refund, the client must cover the cost of return shipping using Colissimo Suivi or an equivalent tracked service.
Returns must be sent to: VISIONALIS – Z.A les petits clais – 18110 St Martin d’Auxigny
6- Prescription eyewear order process
To validate an order for corrective eyewear, the client must provide VISIONALIS with the necessary documents to determine or calculate the wearer’s prescription and pupillary distances. This can be done by accurately completing the "profile" form or by sending the relevant documents.
The client therefore agrees to provide these documents as soon as possible, either through the designated forms during the order process, or via email at contact@visionalis.fr, including their name and order number in the subject line. Each submission is verified by a certified optician, who will contact the client in case of uncertainty or inaccuracy.
You may also visit our store so that our optician can take the necessary measurements in person.
Product delivery will be suspended until the required documents are received. The order will be cancelled if the documents are not provided within 7 days of the order.
7- Pricing policy
All product prices are displayed in euros including all taxes (€ incl. VAT), excluding delivery charges. In the event of a change in the VAT rate, prices will be adjusted automatically without notice other than the effective date of the new rate.
Orders must be paid in euros and immediately upon checkout.
For deliveries and services outside French territory, the applicable provisions of the French Tax Code concerning VAT will apply. Any order shipped outside France may be subject to customs duties and taxes applicable in the destination country. These are the responsibility of the client, who must handle any related charges. Visionalis.fr is not required to verify or inform clients of applicable customs duties or taxes.
Failure by the client to comply with their obligations, particularly in cases of payment incidents, may result in suspension of access to visionalis.fr services, or even termination of their client account, depending on the seriousness of the incident. This does not preclude VISIONALIS from claiming compensation.
VISIONALIS reserves the right to refuse any order from a client involved in an unresolved dispute or payment issue.

Cancellation requests must be sent via email to contact@visionalis.fr. A refund will be issued within 30 working days of the cancellation request.
5. Partial deliveries
The client will be notified by email in the event of a partial delivery. A second email will confirm shipment of the remaining products or services.
6. Delivery completion
Delivery is considered complete once the package is made available to the client. Tracking is available through the carrier’s system.
Without prejudice to the right of withdrawal, the client must check the package upon arrival and make any justified claims or refuse the package if it appears to have been opened or damaged. Claims must be sent to the carrier’s claims department via registered letter with acknowledgment of receipt within 3 working days after delivery. A copy must also be sent to VISIONALIS.
9. Exceptional or Fortuitous Product Unavailability
In the event of total or partial unavailability of a product after an order has been placed, the customer will be informed by email of the delivery of a partial order (with the remainder of the order still valid and binding), or of the cancellation of their order.
In accordance with the provisions of Article L121-20-3 of the French Consumer Code, in the event of product or service unavailability, the customer may choose:
- either to receive a product or service of equivalent quality and price, subject to available stock.
- or to be reimbursed for the price of the ordered product or service within 30 days of their request.
Shipping costs related to any replacement products will be covered by VISIONALIS.
10. Payment
No discount is granted for immediate or early payment. In case of late payment, late fees may be charged at a rate equal to three times the legal interest rate, along with a fixed compensation fee of €40 for recovery costs.
Payment for purchases can be made using one of the following three methods:
1. Credit Card
The customer confirms that they are authorized to use the chosen credit card at the time of the order. Accepted cards currently include: CB, Visa, and MasterCard. For secure transactions, VISIONALIS uses PayBox Services - Crédit Agricole, a secure payment platform. Banking data is encrypted (SSL security standard) and is never transmitted in plain text over the internet. The customer’s account is debited at the time of order placement. Order processing begins once the bank's payment authorization is confirmed.
2. Cheque
The customer must send a cheque payable to VISIONALIS, for the total order amount including taxes and shipping fees. The order number must be written on the back of the cheque. It should be sent to the following postal address:
VISIONALIS, ZA Les petits clais, 18110 ST MARTIN D'AUXIGNY, France
The order will only be processed upon receipt of the cheque. If the cheque is not received within ten days, the order will be cancelled.
3. PayPal
By choosing PayPal, the customer will be automatically redirected to the PayPal website. A valid PayPal account is required to complete the payment. Order processing begins once payment is confirmed.

12. Right of Withdrawal
Under the terms of Article L121-16 of the French Consumer Code concerning distance selling, the customer has a 14-day cooling-off period from the date of delivery to change their mind.
